On January 28, HCPA staff participated in the initial public stakeholder meeting conducted by the Colorado Department of Public Health and Environment (CDPHE). The purpose of this meeting was to discuss the agency’s plans for adopting new state VOC regulations for consumer products and architectural and industrial maintenance (AIM) coatings. Should the CDPHE decide to move forward, HCPA urged the agency to develop a consumer products regulation based on the Ozone Transport Commission (OTC) Phase 2 Model Rule—the version of the OTC Model Rule that forms the basis for current regulations in 10 states and Washington, D.C.

HCPA also argued that the CDPHE should not include a general sell-through limit in any future regulations. HCPA pointed to the fact that there is no such provision in the Environmental Protection Agency’s (EPA) national consumer products regulation or the current OTC-based regulations adopted by 16 states and Washington, D.C. We are pleased to report that while the stakeholders’ meeting took place, the CDPHE stated that it no longer plans to include a sell-through provision in their planned consumer products regulation.

During the meeting, the CDPHE requested that written public comments on the potential rulemaking be filed by February 11, and HCPA has done so.
